does Lao government   have a policy  or law to deal with migration from neighbor country ? we can't chance history but we can learn from the pass . this problem cause major conflict around a world even in Lao with the Hmong minority .

Training course for Lao Party officials opens

A training course on political theory for officials of the Lao People’s Revolutionary Party opened at the Ho Chi Minh National Politics and Administration Academy in Hanoi on August 18.

Hanoi (VNA) – Speaking at the opening ceremony, deputy director of the national academy, Dr Vu Dinh Hoe, said that the Communist Party of Vietnam and the Lao People’s Revolutionary Party consider personnel training a key factor in the past struggles for national independence as well as in the current process of both countries’ industrialisation and modernisation.

During the five-month course, which is held within the cooperation agreement between two countries, 20 Lao Party officials will study the key contents of Maxism-Leninism and Ho Chi Minh’s Thoughts on national independence and socialism.

They will also be updated on current major trends in the world and the Communist Party of Vietnam’s experiences in national renewal cause.

of Prime Minister

on Immigration of Lao People's Democratic Republic

for Lao and Foreign nationals

In order to implement the enlarge policy on external relation and cooperation to protect the independence, sovereignty and security of the nation.

In order to respect the procedures of Immigration Regulation of Lao People's Democratic Republic for Lao and foreign nationals.

Referring to the Submissions of Ministry of Foreign Affairs and Ministry of Public Security.

The Prime Minister of Lao People's Democratic Republic has issued the Decree:

Article 1: On the meanings of the words of this Decree

a- The Words of " Foreign National" means the person who holds the other citizenship entering Lao PDR for short duration of stay, for the Words of " Alien National " means the foreign national who's legally authorized for permanent residence and profession in Lao PDR.

 

b- The Words of " Non-national person " means the person who is not transferred to become any national yet.

 

c- The Words of " Family members " means the spouse, children, brothers, sisters and parents of one person, and those people depend on is/her responsibility living together in a family.

Chapter 1

On Immigration of Lao PDR

Article 2: On the conditions of entering and leaving Lao PDR.

a- Lao nationals who have permanent residences in overseas before entering Lao PDR, they must obtain the Laissez-Passers (travelling notes) from the Embassies or General Consulates of Lao PDR in overseas first.

b- The person needs Visa for entering-leaving Lao PDR, that one must hold the passport or the valid travelling documents officially issued by any State or any Organization.

 

c- The Lao and foreign nationals who are refused to obtain Visa for entering-leaving Lao PDR, that one is related to alert list includes of criminal and civil cases, international theft, the person who acts against the secret and stability of the nation and the person who has the contagious diseases which diagnosed by the Ministry of Health.

+ For the person who's still in term of judgement on criminal or civil case, that one is temporarily rejected to get the Visa or trip to anywhere till the proposal of the investigation division or prosecutor office’s approval.

Article 3: On the principles of Visa issuance

a- The Embassies and General Consulates of Lao PDR have the right to issue the Visa for foreign nationals who have complete conditions and not related to Para. c Article 2 of this Decree

 

b- If the Embassy and General Consulate of Lao PDR does not clearly know the purposes of a person who wishes to enter Lao PDR, that one must ask the approval from the Ministry of Foreign Affairs of Lao PDR first.

 

c- Lao and foreign nationals reside in Lao PDR, who wish to invite their guests to Lao PDR, they must get the approvals from the Ministry of Public Security and Ministry of Foreign Affairs first.

Chapter 2

On the Organizations have the rights to issue the passports

Article 4: On the Organizations have the rights to issue the passports.

a- The Ministry of Foreign Affairs of Lao PDR has the rights to issue the Diplomatic Passports, Service Passports and Ordinary Passports to Lao nationals.

 

b- The Ministry of Public Security shall research and consider to issue the passports (border passes) to the aliens who have permanent residences in Lao PDR.

 

c- The Embassies and General Consulates of Lao PDR in overseas have the rights to issue the Ordinary Passports to Lao nationals and Lao Aliens who have permanent Residences in overseas that they have complete conditions after the approval from the Ministry of Foreign Affairs.

Chapter 3

On the categories of Visas, Authentic Organizations

to issue the Visas and Registration for long duration of stay.

Article 5: On the Categories of Visas as:

1. Diplomatic Visa.

 

2. Service Visa.

 

3. Courtesy Visa.

 

4. Tourist Visa.

 

5. Non-immigrant Visa.

 

6. Immigrant Visa

 

7. Transit Visa.

 

8. Business Visa.

Article 6: On the uses of Categories of Visas.

1. Non-immigrant Visa: is specific uses of Lao nationals, aliens and foreign nationals for the purposes of visit relatives, collect data for investment, trade relation and other good purposes.

 

2. Immigrant Visa: is specific uses of Lao nationals, aliens and foreign nationals for the purposes of entering-leaving Lao PDR longer duration more than three months.

 

3. Business Visa: is specific uses of businessmen who legally invest in Lao PDR.

Article 7: on the Authentic Organization to issue the Visas.

a- The Consular Affairs Department of the Ministry of Foreign Affairs of Lao PDR has the rights to issue the single or multiple Visas for Lao and foreign nationals.

 

b- The Embassies and General Consulates of Lao PDR in overseas have the rights to issue the single trip Visa only, and limit the validity just 60 days.

 

c- The Embassies and General Consulates of Lao PDR in overseas have the rights to issue the transit Visa to transit Lao PDR not more than twice.

 

d- The foreign General Consulates posted in the Provinces of Lao PDR have the rights to issue the Visas just for Lao nationals and Aliens who have the purpose to travel to just that country only.

Article 8: Lao and foreign nationals are available to obtain the multiple Visas as:

a- Diplomats, foreign experts, chiefs of UNDP, Chiefs of international organizations and their family members that they have the missions in Lao PDR more than 90 days.

 

b- Foreign businessmen have legally invested in Lao PDR and they have to work in Lao PDR more than 90 days.

 

c- Lao businessmen and staffs are identified by their organizations and they are necessary to entering-leaving Lao PDR for their duties very often.

Article 9: The entry and exit points of local levels.

a- The visiting of both sides for border line people at localities is the duties of the Headquarters of Municipal and Provincial Police to issue the border passes to Lao nationals in their responsible areas base on the Agreement recognized by the Governments of both sides of neighboring countries.

 

b- The Aliens reside at the localities of Lao PDR who wish to travel to overseas, they must get Visa from the Ministry of Foreign Affairs or the Authentic Provincial Offices.

 

c- The nationals of neighboring countries who hold the border passes entering one province of Lao PDR, they are not allowed to enter other provinces, even direct and close to their province.

Article 10: Awaiting Limit for the Passports and Visas of Lao and foreign nationals after demand the application forms to the Authorities of the Ministry of Foreign Affairs takes times for consideration as details below:

+ Leaving Lao PDR

- New passports 10 days.

- Visa: Diplomatic, Service and Transit 10 days.

- Visa: Non-immigration, Tourist 5 days.

- Visa: Immigration 15 days.

+ Entering Lao PDR

- Immigration Visa for permanent residence and long duration of stay 15 days.

- Other categories of Visas 3 days.

Article 11: Validity of temporary duration of stay in Lao PDR.

1. The Immigration Officers must stamp the duration of stay in the passports of the passengers as:

- For the holders of Diplomatic Visa, Service Visa, Courtesy Visa, Non-immigration Visa, and Immigration Visa not more than 30 days.

 

- For the holders of Tourist Visa not more than 15 days.

 

- For the holders of Transit Visa not more than 7 days.


2. Foreign national entering Lao PDR holding of Non-immigration Visa, who wishes to stay longer, he/she has to demand the application form for Visa Extension at the Department of Immigration, Ministry of Public Security.

Article 12: On the Extension of stay duration in Lao PDR.

- In case of necessity of foreign national who has the purpose to stay longer than the Immigration Officer authorized the duration of stay at the check-point, he/she has to demand the application form for Visa Extension from the authorities concerned 3 days before duration of stay expired.


- Overstay without Visa Extension or intentionally hind him/herself to stay, he/she must meet the fine penalty or be sentenced by Penal Code in accordance with the Regulation of Lao PDR.

Article 13: On the Registration and Id. Cards issuance.

a. Foreign nationals entering Lao PDR for longer term of missions, they must demand the application forms for registrations and Id. Cards at the Department of Immigration, Ministry of Public Security and then demand for multiple Visas at the Department of Consular Affairs, Ministry of Foreign Affairs.


b. For Diplomats, embassy staffs, chiefs of international organizations, and their family members entering Lao PDR for their missions longer than 90 days, they must demand the application forms for registrations and Id. Cards at the Department of Consular Affairs, Ministry of Foreign Affairs.


c. Foreign experts, technical staffs of the embassies, UNDP and other international organizations and their family members (not stated in Para. 1 of this Article), they must demand the application forms for registrations and Id. Cards at the Department of Immigration, Ministry of Public Security.


d. For diplomats and other experts entering Lao PDR for short duration of stay less than 90 days, they just demand the application forms for Visa Extension at the Department of Immigration, Ministry of Public Security.

Article 14: Foreign nationals, Lao nationals permanently reside in overseas and non-citizenship person, when they arrive Lao PDR, they must inform their purposes of stay to the authorities concerned in that locality within 24 hours.

Chapter 4

On the immigration control procedures

at the border crossing points of Lao PDR

Article 15: On immigration system.

a. Foreign nationals have got Visa entering-leaving Lao PDR, must pass the International check-points which officially opened by the Government.


b. For local checkpoints opened by the Government, authorize just for the civilians living adjacent to borders of direct neighboring countries entering-leaving Lao PDR.


c. For foreign experts and businessmen who have invested the projects in the provinces where local checkpoints posted, they can enter and leave through those points.

Article 16: On Regulation of Immigration.

a. The person who enters-leaves Lao PDR, must respect the regulation and through the checks of the authorities at the checkpoints.


b. The person who enters-leaves Lao PDR, must get exception of checking of the customs agents at the checkpoints, that one is the holder of diplomatic passport and in case of the special high ranking delegate of the party-government, but must be identified by the organization concerned.

Article 17: Foreign national entering Lao PDR for temporary stay, he/she is not authorized to complete the documents to apply for a job, except the one who needs Joint Venture or employment that authorized by the Ministry of Labor and Social Welfare.

Article 18: Assign the Ministry of Foreign Affairs, Ministry of Public Security and Ministry of Communication, Transport, Post and Construction to design the components of the buildings of the international checkpoints that can be the plans referred of the construction which is suitable in each place.

Chapter 5

On the applications for permanent residences in Lao PDR

Article 19: Laotian, foreigner and alien who demand the application forms for permanent residences in Lao PDR, they must meet the conditions below:

- The person who had ever been to Laos many years before and his/her name was not recorded in the criminal record while he/she was in Laos in the past.

 

- The person who was born in Laos, Lao nationality and over 60 years old.

 

- The person who has parents, spouse or children who has permanent residence in Lao PDR before.

 

- The person who has experience profession which met the demand of Lao PDR and the person who invested in Lao PDR.

Article 20: On the conditions of the guarantor of the relative to live permanently in Lao PDR.

a. The guarantor who bears Lao nationality.

 

b. The guarantor who bears the foreign nationality (foreigner) has been living in Lao PDR over 10 years.

 

c. The foreigners who invest a lot of money in Lao PDR.

+ Composition of Documents:

1. Residence certificate sticked photograph = 3 copies.

 

2. Bio-data = 3 copies.

 

3. Warranty certificate = 3 copies.

 

4. Copies of I. D. Card = 3 copies.

 

5. Copies of family census book = 2 copies.

 

6. Proposal paper of Police Headquarter of Province and Municipality

= 2 copies.

 

7. Application form for permanent residence of the relatives in Lao PDR

(self hand written) = 2 copies.

 

8. Report of properties (specify his/her own economy) certified by local Administrative = 2 copies.

+ For the applications of the person who wishes to permanently live in Lao PDR

2. Bio-Data = 1 copy.

 

3. Copy of I. D. Card = 1 copy.

6. Heath certificate = 1 copy.

 

7. Birth certificate = 1 copy.

 

8. Report of properties (specify his/her own economy) = 1 copies.

d. The guarantor must complete the documents for approvals from the local administrative concerned, Police Headquarters of Provinces or Municipality, and then send to the Department of Immigration, and the Department of Consular Affairs for consideration.

 

e. The application wishes to permanently live in Lao PDR must complete the documents for approvals from the Embassy or General Consulate of Lao PDR in the country where he/she lives, then demand to the Department of Consular Affairs, Ministry of foreign affairs after that the Consular affairs Department will approve and then attach the documents of the guarantor together send to the Department of Immigration, Ministry of Public Security for final approval.

Chapter 6

On the cost fee

Article 21: The fee issuance of passports, travelling documents (Titre de Voyage ) to replace the passport, other travelling documents, Visa of stay in Lao PDR and the fees of fine penalties ( except the over time fees and services fees those are the incomes of the state ).

Article 22: The rates of cost fees and fines fees are implemented by the decree

Article 23: The collection of cost fees and fines fees must collect only one rate and on time, after that don’t collect any more, even at the Immigration checkpoints and other units through out the country.

Article 24: Ministry of Finance has the rights to set up the control units to collect the cost fees and fines fees enter the country when necessity.

Chapter 7

Article 25: The Minister of Ministry of Foreign Affairs, the Minister of Ministry of Public Security mutually define the regulation properly and implement this Decree, any article related to the roles and duties of other Ministries, must discuss with the Minister of that Ministry and define the regulation properly for their officers to correctly implement.

Article 26: This Decree is replaced the Decree No: 51 / CoCoM of foreigners and privileged from the date of the signature, other Regulations and Decrees which contradicted this Decree are all cancelled.
